NANb Chat — Terms of Service
Last updated: July 1, 2026
Welcome to NANb Chat (“the app”, “NANb Chat”, “we”, “us”, “our”), a privacy-focused, end-to-end-encrypted messenger operated by the independent developer of NANb Chat. These Terms of Service (“Terms”) form a binding agreement between you and us and govern your use of the app and related services (together, the “Service”).
Please read these Terms carefully. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
- You must be at least 13 years old to use NANb Chat.
- You are responsible for the content you send and for how you use the app.
- There is zero tolerance for objectionable content and abusive users. You can report and block other users, and we may remove content or terminate accounts.
- Because your messages are end-to-end encrypted, we cannot read them and cannot pre-screen them — enforcement relies on the reports you send us.
- The Service is provided “as is”, without warranties.
1. Who we are and how to contact us
NANb Chat is operated by its independent developer. For any question or request about these Terms, contact us at contact@nanb.us.
2. Eligibility and age requirement
By using the Service you represent that:
- you are at least 13 years old (or the minimum age of digital consent in your country, if higher);
- you have the legal capacity to enter into these Terms;
- you are not barred from using the Service under any applicable law, and you are not located in a country or on a list subject to relevant sanctions or embargoes; and
- you will comply with these Terms and all applicable laws.
The Service is not directed to children under 13, and we do not knowingly allow them to create accounts.
3. Your account and devices
- You sign up with a username you choose. No phone number or email address is required.
- You are responsible for safeguarding your device, your recovery phrase, and any app-lock PIN or biometric. Because NANb Chat is end-to-end encrypted and we never hold your keys, we cannot recover your account, reset your encryption keys, or restore your message history for you. If you lose your recovery phrase and access to your linked devices, you may permanently lose access to your account and its data.
- You may link a limited number of devices to your account. Keep every linked device secure; anyone with access to a linked, unlocked device can use your account.
- Notify us at contact@nanb.us if you believe your account has been accessed without your authorization, understanding that our ability to intervene is limited by the app’s end-to-end-encrypted design.
4. Acceptable use
You agree not to use the Service to, or to help anyone else to:
- violate any law or the rights of others;
- harass, threaten, bully, stalk, defame, or intimidate any person;
- create, request, store, or share child sexual abuse material (CSAM) or any content that sexually exploits or endangers minors — this is strictly prohibited and, where required by law, reported to the appropriate authorities;
- promote, plan, or facilitate terrorism, violent extremism, or violence against any person or group;
- send spam, malware, phishing, or fraudulent or deceptive content;
- infringe any patent, trademark, copyright, trade secret, or other intellectual-property or proprietary right;
- impersonate any person or entity or misrepresent your affiliation;
- attempt to breach or circumvent the security of the Service, reverse engineer it except to the limited extent permitted by law, interfere with or overload the infrastructure, or evade any limit or protective measure; or
- otherwise use the Service to harm minors or any other person.
5. Zero tolerance for objectionable content and abusive users
NANb Chat has no tolerance for objectionable content or abusive behavior. Objectionable content includes, without limitation, content that is illegal, harassing, threatening, hateful, sexually exploitative of minors, or that promotes violence.
- You can report content or users from within the app (open the contact’s profile → Report, choose a reason, and optionally add a note). Submitting a report forwards the relevant recent messages to us as evidence.
- You can block other users at any time so they can no longer contact you.
- We review reports and may, at our discretion and without prior notice, remove content we are able to access, revoke devices, and suspend or terminate the accounts of users who violate these Terms. Where appropriate, we may report unlawful activity to law enforcement.
- Encryption limitation: because messages and media are end-to-end encrypted, we cannot proactively monitor or filter the content of communications. Our enforcement is based on the reports users submit, which is why the report and block tools exist and why we act on them.
We aim to act on valid reports of objectionable content and abusive users within a reasonable time of receiving them.
6. Your content and your responsibility
- You retain ownership of the content you create and send. You are solely responsible for that content and for the consequences of sending it.
- You represent that you have the necessary rights to send your content and that it does not violate these Terms or any law.
- Because your content is end-to-end encrypted, we do not access it, except the specific messages you voluntarily submit to us through the in-app report feature.
- You grant us a limited, worldwide, royalty-free license to transmit and store the encrypted form of your content solely to operate and provide the Service (for example, to relay ciphertext to your recipients’ devices). This license does not give us the ability to read your content, and it ends when the content is delivered or deleted as described in our Privacy Policy.
7. Reporting, moderation, and enforcement
Reports you submit are placed in a moderation queue that we review out of band. We may take any action we consider appropriate, including removing accessible content, revoking devices, and suspending or terminating accounts. We are not obligated to monitor the Service, and given its end-to-end-encrypted design we generally cannot. Our decision to act, or not to act, on any particular report does not waive our right to act on others.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, available at https://www.nanb.us/privacy/nanb-chat-privacy, which explains what limited information the app handles and what we can and cannot see. By using the Service you acknowledge the Privacy Policy.
9. Third-party services
The Service relies on third-party infrastructure, and your use may be subject to those providers’ terms:
- Amazon Web Services — hosting and encrypted storage of ciphertext.
- Google (Firebase Cloud Messaging) and Apple (Apple Push Notification service) — only if you enable push notifications, and only to deliver content-free wake-up pushes.
- The Tor network — used by default to route the app’s traffic.
We are not responsible for third-party services and do not control them.
10. Apple App Store (for apps obtained from Apple)
If you obtained NANb Chat from the Apple App Store, the following also applies and, to the extent of any conflict, controls for that copy of the app:
- These Terms are between you and us only, not with Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to furnish any maintenance or support for the app.
- To the maximum extent permitted by law, Apple has no warranty obligation with respect to the app, and any claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to a warranty are our responsibility, not Apple’s.
- Apple is not responsible for addressing any claims by you or a third party relating to the app, including product-liability, legal/regulatory, or intellectual-property claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties.
11. Service availability and changes
NANb Chat is under active development. We may add, change, suspend, or discontinue any part of the Service at any time, and features may change or be removed. We may also update the app, and some updates may be required for continued use.
12. Disclaimers
The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that messages will always be delivered.
While NANb Chat is designed to provide strong end-to-end encryption and network privacy, no system is perfectly secure, and we do not guarantee that the Service cannot be compromised.
13. Limitation of liability
To the maximum extent permitted by law, NANb Chat and its developer will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or business, arising out of or relating to your use of (or inability to use) the Service, even if advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the total amount you paid us to use the Service in the twelve months before the claim (typically US $0, because the app is free), or (b) US $50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless NANb Chat and its developer from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms or of any law or the rights of a third party.
15. Termination
You may stop using the Service at any time and delete your account from within the app (Settings → Account → Delete account). We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or to protect the Service or its users. Provisions that by their nature should survive termination (including Sections 6, 12, 13, 14, and 15) will survive.
16. Governing law and disputes
These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-laws rules. You and we agree to first try to resolve any dispute informally by contacting contact@nanb.us. If a dispute cannot be resolved informally, the state and federal courts located in Maricopa County, Arizona will have exclusive jurisdiction and venue, and you consent to personal jurisdiction there, except where prohibited by applicable law.
17. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and post the new version at this URL. Significant changes may also be highlighted in the app. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
18. Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the Service.
19. Contact
